- Acceptance of the Terms and Conditions
By using our Services, you confirm that you are of legal age and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please refrain from using our Services. Your acceptance of these terms can be demonstrated by registering with the Services or actively using them. If you do not agree to these terms and conditions, please do not use our platform.
- Our Services
Finder Plus provides comprehensive IoT based solutions tailored to the needs of various industries. Our digital platform includes a range of solutions, including fleet management, fuel monitoring, temperature monitoring, intelligent speed control, video telematics, generator monitoring, equipment monitoring, intelligent load management, ship and container tracking, ready mix solution and more. These solutions will provide you with asset tracking in real-time, live dashboard of trip/task overview, geofencing, geo-based notifications, field task management, real-time communication, fuel consumption tracking, vehicle maintenance scheduling, along with mobile apps and after sales services. The services will be provided for an upfront price which is subject to acceptance by the respective user and the company for which you are responsible in terms of internet access and necessary equipment.
- Software License Related Terms
4.1. Documentation License: Finder Plus grants the Customer a non-assignable, non-transferable license, without the right to sub-license, to use the Documentation in connection with the authorized use of the Hosted Software. The Customer may not reproduce or distribute the Documentation without express written permission from Finder Plus.
4.2. Language File License: The Hosted Software is provided with all available language files.
4.3. Ownership: Finder Plus retains ownership of the Hosted Software and source codes, and source code files are not provided.
4.4. Up-time: Finder Plus guarantees 99.99% server up-time, excluding scheduled maintenance, emergency maintenance and force majeure events, and hardware failures within the Customer’s server.
4.5. Down-time: As part of our dedication to continuous improvement and delivering an exceptional user experience, we occasionally schedule brief periods of downtime to perform essential system upgrades, maintenance, and enhancements.
4.6. Technical Support: Finder Plus agrees to provide technical support services to the Customer, including periodic distribution of bug fixes and minor enhancements as Updates. Technical support inquiries can be submitted via email, and responses will be provided within a reasonable time frame.
5.1. Subscription Charger: Payment terms for software licenses are determined based on the agreement specific to the license service. For subscription-based models (such as “Pay per use”), the following terms may apply:
– Service fees are charged monthly unless otherwise agreed upon.
– All payments must exclude applicable taxes and fees for bank transfers. Any applicable taxes (e.g., VAT) are the Customer’s responsibility in accordance with local legislation.
– Finder Plus reserves the right to modify fees and charges with at least 30 days’ prior notice by email.
– By using third-party payment processors integrated into the Finder Plus platform, you agree to their respective terms of service.
– All fees and charges are non-refundable, regardless of usage periods.
5.2. Refund policy: You agree and acknowledge that you believe in our success story and take our services with confidence. You agree and acknowledge before selecting services and making payment, you have evaluated our services completely as per your requirements. Also, you agree and acknowledge that there is a lot of work involved to achieve every milestone while offering services to you and therefore it shall be very difficult for us to provide any refund.
6.1. Termination Conditions: Finder Plus will terminate the service(s) if any valid complaint is received/made against the subscriber for any unlawful or abusive purposes, or for sending obscene, in decent, threatening, harassing, unsolicited message or message adversely affecting/infringing upon national, social, or economic interest nor create any damage or risk to Finder Plus or its network and/or other subscribers.
6.2. Termination Rights: Finder Plus also reserves the right to terminate the service(s) if the subscriber fails to pay the monthly service charge within 60 days of issuance of the unpaid monthly service charge.
All Terms and Conditions herein contained are independent of each other. If any provision of these Terms and Conditions is held to be inapplicable or unenforceable the balance of the Terms and Conditions shall remain unaffected and in full force and effect, unless our obligations are materially impaired, in which event we have the right to terminate the Agreement.
- Government Law
The agreement, its validity, construction and performance is governed by applicable laws of Bangladesh.
- Service Provider’s Responsibility
Responsibilities of Finder Plus are explicitly stated in this agreement, and Finder Plus takes no other responsibility.
